The Chhattisgarh High Court, in a ruling by Justice V.K. Shrivastava, has directed both parties in a maintenance case to undergo a DNA test to determine the paternity of two minor children. The order came after the husband, respondent Rakesh Diwan, denied both the marital relationship and the paternity of the children born to applicant Smt. Asha Diwan.
The case originated when Asha Diwan and her two children filed an application under Section 125 of the Code of Criminal Procedure (CrPC) seeking maintenance. She claimed that she had been legally married to Rakesh Diwan and that the two children were born from their marriage. However, the respondent’s outright denial led the applicants to request a DNA test to establish the truth.
The Chief Judicial Magistrate of Dhamtari had earlier rejected this request on January 31, 2005. Challenging that decision, the applicants approached the High Court under Section 482 of the CrPC, seeking directions for the DNA test to conclusively determine paternity.
Justice Shrivastava observed that when the mother and the children voluntarily agree to undergo a medical test and even offer to bear the costs, such a scientific method should be used to resolve the dispute. The Court held that determining paternity is in the best interest of the minor children and necessary for ensuring justice in the maintenance proceedings.
The High Court directed that the DNA test be conducted upon payment of the expenses within 15 days. Both parties were instructed to make themselves available for testing. The Court also made it clear that if either party refuses to comply, the trial court is entitled to draw an adverse inference under the law against the party refusing the test.
