The Chhattisgarh High Court has overturned the orders of the Juvenile Justice Board and the Sessions Court, directing that two juveniles accused in a kidnapping case be released on bail. Justice Sunil Kumar Sinha held that both authorities failed to apply Section 12 of the Juvenile Justice Act, 2000 in the manner intended by the law.
The case involves two boys, Bharat and Shobha, who were arrested in December 2004 in a case registered under Section 363 read with Section 34 of the Indian Penal Code. They were initially housed at the Samprekshan Grih in Mana but fled while being brought back from a hospital visit. They later surrendered before the Board and sought bail, which was denied on the ground that their earlier escape meant that granting bail would defeat the ends of justice.
The High Court found that the Board and the Sessions Judge focused solely on the fact that the boys had run away, while ignoring what the juveniles had stated in their surrender application. The boys said they fled because they were being assaulted by older inmates at the home and their complaints were not addressed. Justice Sinha noted that this explanation was never considered, even though the Act requires authorities to look at the child’s welfare and the specific circumstances raised.
The Court held that Section 12 of the Act creates a clear rule: a juvenile should ordinarily be released on bail unless one of three specific conditions applies. The only condition cited by the lower authorities was the possibility that bail would defeat the ends of justice. The High Court said that this conclusion could not stand without examining the boys’ stated reasons for leaving the home, especially when they later surrendered voluntarily.
Setting aside both earlier orders, the Court directed that the juveniles be released on bail upon furnishing a bond of Rs. 5,000 each, with sureties from a parent or guardian.
