The Chhattisgarh High Court has dismissed a criminal revision petition challenging the framing of charges against the wife of a Bhilai Steel Plant (BSP) officer accused of amassing assets disproportionate to his known sources of income. Justice Dilip Raosaheb Deshmukh upheld the Special CBI Court’s order that charged the officer, Bharat Lal, under Section 13(2) read with Section 13(1)(e) of the Prevention of Corruption Act, 1988, and his wife under the same provisions read with Section 109 of the Indian Penal Code for abetment.

According to the Central Bureau of Investigation (CBI), Bharat Lal, who served as Deputy General Manager at BSP between 1991 and February 2002, was found in possession of disproportionate assets worth over ₹23 lakh. Investigators alleged that his wife, identified as Petitioner No. 2, abetted the offence by submitting false income tax returns over several years to disguise the source of wealth. She reportedly declared income from a beauty parlor, saree trading, tuition, and bank interest, none of which could be substantiated during investigation.

The CBI also accused the couple of fabricating a will purportedly executed by Bharat Lal’s father to justify the possession of large quantities of gold ornaments. The court noted that the will, dated January 24, 2002, appeared to be bogus and was executed on a stamp paper not purchased by the alleged testator. Justice Deshmukh observed that the timing and circumstances of the will’s execution indicated an attempt to conceal illicit assets.

The defence argued that even if the will was fabricated, it was created after the alleged offence and therefore could not amount to abetment. However, the court rejected this contention, finding that the evidence, including statements from a stamp vendor and the drafting advocate, supported the prosecution’s claim that the document was created to camouflage the true source of the gold.

Citing the Supreme Court’s ruling in P. Nallammal v. State (1999), the court reaffirmed that any person who abets a public servant in acquiring disproportionate assets can be prosecuted under the Prevention of Corruption Act. Justice Deshmukh concluded that the wife had “intentionally aided” her husband in accumulating unexplained wealth by filing false returns and helping create a fabricated will.

Finding no illegality or procedural error in the CBI court’s order, the High Court dismissed the revision petition as “devoid of merit,” allowing the charges against the wife to stand.
