The Chhattisgarh High Court has upheld the conviction and life sentence of a man found guilty of murdering his five-year-old nephew in Bastar over a superstition-driven dispute. The Division Bench led by Justice Sunil Kumar Sinha dismissed the appeal filed against the Sessions Judge’s order dated February 23, 2001, which had convicted the accused under Section 302 of the Indian Penal Code.

According to the prosecution, the accused killed the child, Atami Bachnu, on February 1, 2000, after developing an unfounded belief that his cousin, Atami Sonaru, had performed witchcraft preventing him from having a male child. The accused, who had four daughters, had earlier quarreled with Sonaru and threatened to kill his son.

On the night of the incident, as the family slept in their verandah, the accused attacked the boy with a Tangia (axe-like weapon), striking him fatally on the chest. The assault was witnessed by the victim’s parents, who identified the attacker in the light of the burning hearth and a small lamp.

During the investigation, police recovered the weapon based on the accused’s statement under Section 27 of the Evidence Act. The postmortem confirmed a lacerated chest wound that fractured ribs and ruptured the heart, leading to death by hemorrhagic shock.

The defense argued that inconsistencies between medical and eyewitness accounts—particularly that witnesses claimed three blows while only one injury was found—made the conviction unsustainable. However, the High Court rejected this contention, observing that minor inconsistencies do not undermine credible eyewitness testimony, especially when supported by motive, prior threats, and the accused’s absconding after the incident.

Justice Sinha cited precedents from the Supreme Court emphasizing that credible ocular evidence cannot be discarded merely because of slight medical discrepancies. The court found the parents’ testimonies trustworthy, noting their presence at the scene was natural and corroborated by other circumstances.

The court concluded that the prosecution had proved the charge of murder beyond reasonable doubt and affirmed the life sentence. The appeal was dismissed as devoid of merit.
