The Chhattisgarh High Court has directed Pt. Ravishankar Shukla University and the State to ensure that retired university employees and their dependants receive pensionary benefits at the same rates and on the same terms as State Government employees. Justice Satish K. Agnihotri, writing for the court, framed the decision around statutory documents and longstanding government circulars that together establish a legal basis for parity.

The petitioners, who retired from the university and sought revised pension and family pension, pointed to Statute No. 32 of the university and a 6 December 1989 circular issued by the then Government of Madhya Pradesh. Those instruments envisage a University Employees Pension and Gratuity Fund, funded by university and employee contributions and to be centrally administered by the higher education grant authority. The court reviewed those provisions and traced how the grant authority’s functions and responsibilities were carried over to the State Government after the statutory dissolution of the Ayog in 1994.

Justice Agnihotri noted that the statute required each university to contribute to a central pension and gratuity fund, with the State empowered to make grants to cover shortfalls. The court relied on established legal principles that pension rights are not mere bounties but valuable rights that follow from lawfully made regulations. On that basis the court ordered that pension, family pension, gratuity and related retirement benefits be paid to the petitioners in accordance with Statute No. 32 and the government circulars, and be revised whenever the State Government revises pensions for its own employees.

The State had already accepted in pleadings that the university employees were, in principle, entitled to similar retirement benefits and pointed to recent grant support to the pension fund. The university’s counsel emphasized that, as a State university, its finances fall under State oversight and that the government is responsible for discharging liabilities flowing from the statute. The court’s order resolves the legal dispute in favor of the retirees and remits implementation to the respondents, leaving the parties to bear their own costs.

This ruling highlights the binding character of service regulations made under statutory authority and clarifies that institutional arrangements which create contributory pension funds do not excuse the State from ensuring that pension promises are honored. Retired employees of state universities and their families should now expect pension adjustments to follow the same timeline and rates that apply to State Government retirees, subject to the fund’s administration and any statutory conditions.
