The Chhattisgarh High Court has set aside a Motor Accidents Claims Tribunal award that had granted compensation to a vehicle owner for damage to his own vehicle. Justice Dhirendra Mishra held that a claim by the insured owner for damage to his vehicle is not maintainable under Section 166 of the Motor Vehicles Act, 1988, as the jurisdiction of the Claims Tribunal is confined to third-party claims.
The case arose from a 1994 accident involving a Matador 407 (Reg. No. MP 24-C/1592) insured with the appellant Insurance Company. The IIIrd Additional Motor Accidents Claims Tribunal, Durg, had on 5 November 1999 awarded Rs 20,000 to the owner towards repair costs. The insurer appealed, arguing that the claim was not a third-party claim and therefore fell outside Sections 165 and 166.
After examining the statutory scheme, the Court underscored that Section 165 empowers a Claims Tribunal to adjudicate claims for death or bodily injury to persons or damage to the property of a third party arising out of the use of motor vehicles. Section 166 permits applications by persons who suffered injury, owners of damaged property, or legal representatives in the case of death, but the “property” contemplated for Tribunal jurisdiction is that of a third party. An owner’s own-damage claim does not qualify.
The Court relied on the Madhya Pradesh High Court’s view in New India Assurance Co. Ltd. v. P.N. Vijaiwargiya and the single-judge ruling in National Insurance Co. Ltd. v. Santosh Kumar, both of which draw a clear line between third-party property damage, which the Tribunal can decide, and an insured owner’s damage claim, which it cannot.
Noting that the Tribunal had not addressed this legal objection, the High Court found the award “indefensible,” allowed the insurer’s appeal, and set aside the compensation. It clarified that the claimant is free to pursue appropriate remedies available in law for recovery of the repair costs, and that the present judgment will not stand in the way of such proceedings.
The ruling reinforces a consistent interpretation across High Courts that Motor Accidents Claims Tribunals are not the forum for owners to pursue own-damage claims against their insurers. Those disputes typically belong in civil proceedings or are to be resolved under the policy’s contractual mechanisms. For practitioners, the decision is a reminder to channel owner-damage claims through the proper forum from the outset.
