Justice Dilip Raosaheb Deshmukh has allowed an appeal overturning an earlier tribunal award after finding that the insurer could not be held liable because the vehicle’s driver was not licensed to operate a passenger-carrying commercial vehicle. The case arises from a 2006 accident near Raipur in which a young child was tragically killed when a Mahindra & Mahindra mini bus crushed the child beneath it. The Twelfth Additional Motor Accidents Claims Tribunal (Fast Track Court), Raipur, had originally awarded compensation, but the appellate court has shifted responsibility away from the insurer.
The facts are straightforward and important. On November 22, 2006, the minibus, registered as C.G.-04/D/4509 and insured as a passenger-carrying commercial vehicle, was involved in an accident caused by what the tribunal found to be rash and negligent driving. The vehicle’s driver held a licence that authorized him only to drive a light motor vehicle. There was no endorsement on his licence permitting him to drive transport vehicles or passenger-carrying commercial vehicles. The tribunal had imposed joint and several liability on the insurer and the vehicle’s owner and driver, awarding a total of Rs. 1,65,000.
On appeal, the court reviewed statutory requirements in the Motor Vehicles Act, 1988, which make it clear that driving a transport vehicle requires a licence endorsement for that class of vehicle. The judge noted that an “educational institution bus” falls within the legal definition of a transport vehicle, and that after the 1995 amendment to Section 10 of the Act licences are required to specify the classes of vehicles the holder may drive.
The appellate judgment relied on precedent in which the Supreme Court has held that insurers are not required to indemnify awards where the driver was not authorized by licence to operate the class of vehicle involved in the accident. Applying those authorities, the court concluded that because the driver lacked the necessary endorsement, the insurance company could not be held liable. The court therefore allowed the appeal and ordered that the compensation be recovered from the owner and driver instead.
This decision underscores a recurring legal principle: when a driver operates a vehicle beyond the scope of the driving licence, the burden of compensation may shift away from the insurer, even where the vehicle itself was insured as a passenger-carrying commercial vehicle. The ruling serves as a reminder to vehicle owners and employers to ensure that drivers have appropriate endorsements for the vehicles they are assigned to drive.

Syed Ibrahim, New India Assurance Co. Ltd. v.
