Chhattisgarh High Court Upholds State Transport Authority’s Permit Order

Citation : 2008 Local Law (CG) 262

The High Court has rejected a challenge to a state authority’s decision that granted a bus permit with conditions, holding that the statutory one-month notice requirement invoked by the petitioner did not apply to the body that issued the permit.

The dispute began when an applicant sought a stage-carriage permit to run services on a long inter-district route. The State Transport Authority granted the permit after publishing a public notice and, as part of its order, attached a set of conditions. The petitioner accepted the grant of the permit but objected to one particular condition identified in the record only as “condition No. 4” and appealed to the State Transport Appellate Tribunal. The tribunal dismissed the appeal, and the petitioner then moved the High Court.

At the core of the petitioner’s argument was Section 72(2)(xxii) of the Motor Vehicles Act, 1988, which, on its face, requires a Regional Transport Authority to give not less than one month’s notice before varying conditions attached to a permit or adding further conditions. The petitioner relied on earlier case law to contend that the one-month notice requirement should bind the authority that attached the condition in this case.

The High Court carefully considered the statutory text and the legal precedents cited by both sides. It observed that the provision relied upon explicitly refers to the Regional Transport Authority and that the permit challenged in this petition had been issued and conditioned by the State Transport Authority. On that basis the court concluded that the one-month notice requirement under Section 72(2)(xxii) did not apply to the State Authority’s action. The bench also noted existing Supreme Court authority addressing parallel provisions in the earlier Motor Vehicles Act, 1939, and took the view that those precedents supported the distinction between powers exercisable by regional authorities and those vested in the State Authority.

Because the impugned order was made by the State Transport Authority and the appellate tribunal had given a full hearing to the petitioner, the High Court found no legal infirmity in the decisions below. The petition was dismissed and the permit together with the attached conditions was upheld. The court made no order as to costs.

This judgment clarifies that the procedural protection of a statutory one-month notice before varying permit conditions is directed at regional authorities and does not automatically restrict state transport authorities that issue permits under the Motor Vehicles Act.
