The Chhattisgarh High Court has allowed anticipatory bail to a municipal councillor who feared arrest in a case registered in 2004 for alleged caste-based abuse, assault and criminal intimidation. The single-judge order, delivered by Justice L.C. Bhadoo, follows the court’s finding that the First Information Report does not explicitly allege the specific intent required to attract the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.

According to the record, the complainant, also a member of the same municipal council, reported that the accused and a group of people entered his office in March 2004, used caste-based and obscene language, struck him several times and threatened him. The accused responded that he had earlier filed a complaint against the complainant on the same day, and that the two sides had exchanged complaints after an internal dispute. The prosecution case remains under investigation.

The court examined whether the statutory threshold for an offence under Section 3(1)(x) of the SC/ST Act was satisfied. That provision requires not only an insult or intimidation in public view but also a deliberate intention to humiliate a person because they belong to a scheduled caste or tribe. The judge noted that the FIR recorded caste-related and abusive words, but did not state that those words were used with the requisite intent to intimidate or humiliate the complainant because of his caste.

Taking those facts into account, and noting that both the accused and the complainant are public representatives and there were cross-complaints arising from the same dispute, the court concluded that the case was suitable for anticipatory bail. The bench directed that if the accused is arrested he shall be released on furnishing a personal bond of Rs. 10,000 and a surety of the same amount to the satisfaction of the investigating officer. Standard conditions under Section 438 of the Criminal Procedure Code were imposed, including a prohibition on attempting to intimidate or influence witnesses. The order remains in force for two months, during which the accused is expected to seek regular bail from the trial court.

The ruling highlights how courts scrutinize the specific elements of offences under the SC/ST Act, particularly the requirement of intent, when deciding pre-arrest relief. It also shows the judiciary’s caution when allegations arise between public figures who have lodged competing complaints.

The accused has temporary protection from arrest, but the matter will proceed through investigation and the trial court. The prosecution may seek to add evidence or detail the intent element; conversely, the defence can rely on the High Court’s finding about the FIR’s omissions when arguing for regular bail or at trial. The two-month window set by the High Court gives both parties time to frame their next steps before the trial court.
