The Chhattisgarh High Court has affirmed the conviction of Motilal, who was sentenced to seven years’ rigorous imprisonment for abetment of suicide and three years for cruelty toward his wife, under Sections 306 and 498A of the Indian Penal Code. Justice L.C. Bhadoo delivered the judgment, dismissing Motilal’s criminal appeal and directing him to surrender to serve the remainder of his sentence.
The case dates back to 1985, when Shakuntala Bai, Motilal’s wife, died by consuming poison at her matrimonial home in Deori village. The prosecution established that she had been subjected to repeated harassment, dowry demands, and physical abuse. Her father, Bhuwanlal, reported that Motilal had demanded Rs. 3,000 from the family and insisted on receiving new stainless steel utensils after breaking the brass ones gifted during marriage. Witnesses, including Shakuntala’s parents and brother, confirmed the consistent ill-treatment she faced.
Adding to the distress, evidence showed that Motilal had an illicit relationship with his sister-in-law, Surjabai, which Shakuntala had discovered. The court found that after she confronted him, Motilal assaulted and threatened her not to disclose the affair. This constant mental and physical torment, coupled with financial pressure and humiliation, ultimately drove her to take her own life.
Rejecting the defense’s argument that contradictions existed in the witnesses’ statements, the Court held that the testimonies were consistent and credible. It also dismissed the contention that Motilal’s financial stability negated any dowry demand. Justice Bhadoo observed that both the dowry harassment and the extramarital affair were factors that “provoked and abetted the deceased to commit suicide.”
The Court also clarified that even though the charge was framed under Section 306 read with Section 34 IPC, the absence of a co-accused conviction did not prejudice the appellant, since the charge’s language sufficiently covered the substantive offence.
Citing previous Supreme Court decisions, Justice Bhadoo distinguished this case by noting the strong evidence of cruelty and abetment, stating that “the prosecution has been able to prove that the accused, by his conduct, harassment and threats, created such circumstances that compelled the deceased to end her life.” Concluding that the trial court’s findings were “sound and supported by evidence,” the High Court dismissed the appeal and ordered Motilal’s immediate surrender.
