The Chhattisgarh High Court has granted anticipatory bail to Joginder Singh, who was facing arrest in connection with Crime No. 125 of 2002 registered at Tumgaon Police Station under Section 49A of the Chhattisgarh Excise Act. The order was delivered by Chief Justice K.H.N. Kuranga, who found no strong basis to hold that the liquor allegedly linked to Singh was unfit for human consumption.

During the hearing, the State opposed the bail plea, arguing that the petition under Section 438 of the Criminal Procedure Code (Cr.PC) was not maintainable due to Section 59A of the Excise Act. However, the court disagreed, observing that the prosecution had failed to establish a prima facie case under Section 49A.

The case arose after a police raid on August 18, 2002, at the residence of Ramadhar, a co-accused. Officers seized about 30 litres of O.P. liquor and two empty drums. Ramadhar was arrested, but his sister, Sukhiya Bai—the house owner—was not made an accused. In her statement, she claimed the liquor belonged to Joginder Singh.

The defence pointed out that the report from the Judicial Science Laboratory, Raipur, did not indicate the seized liquid was harmful to human life. The report further stated that the liquor could be consumed safely after proper dilution and that its origin could not be determined.

Chief Justice Kuranga noted that without clear evidence proving the liquor was unfit for consumption, the ingredients of the offence under Section 49A were not met. He observed that the statement by Sukhiya Bai alone was insufficient to implicate Joginder Singh.

Concluding that the case did not justify denial of anticipatory bail, the court directed that in the event of Singh’s arrest, he be released upon furnishing a personal bond of ₹10,000 with two sureties of the same amount. The applicant must cooperate with the ongoing investigation. With this, Miscellaneous Criminal Petition No. 4414 of 2002 was disposed of.
