The High Court of Chhattisgarh on November 12, 2025, granted regular bail to 28-year-old Trilok Singh Nagesh, who had been in custody since August 26, 2025, after being arrested in a case under Section 306 of the Indian Penal Code relating to the suicide of his wife. Chief Justice Ramesh Sinha, writing the order on board, took into account the prosecution record, the contents of the suicide note, and the absence of eyewitnesses before concluding that bail was appropriate while trial proceeds.
The prosecution’s brief reads that on August 13, 2023, the applicant’s wife, identified in court papers as Sanjana Nagesh, died by hanging and that a case was subsequently registered at Chhura Police Station in Gariyaband, recorded as Crime No. 35/2024. Statements recorded by police included allegations from the deceased’s parents that the husband had behaved in a manner that caused mental harassment, but the suicide note itself did not name or allege conduct by the husband. The state had already filed the charge sheet in the matter.
In granting bail, the court balanced the seriousness of the offence with procedural realities. The bench noted there were no eyewitnesses to the event and emphasized that the suicide note does not specifically accuse the applicant. The order also observed that the accused had remained in custody for a prolonged period and that the trial was likely to take time to conclude. On that basis, the court found the applicant entitled to bail, subject to conditions.
The bail is conditional and structured to protect the integrity of the trial process. Trilok Singh was ordered released on furnishing a personal bond with two local sureties. The court required him to give an undertaking not to seek adjournments on dates when witnesses are present and to remain available for each court date either personally or through counsel. The trial court retains power to treat deliberate absences or abuse of bail as grounds for appropriate action, including proceedings under the relevant provisions of the Bharatiya Nyaya Sanhita. The High Court directed that a certified copy of its order be sent to the trial court for compliance.
