Citation : 2007 Local Law (CG) 121

The Chhattisgarh High Court has partly allowed three appeals seeking enhanced compensation in a 2000 tractor accident case while dismissing four related appeals filed by the tractor’s owner. The decision, delivered by Justice L.C. Bhadoo, addresses multiple claims stemming from the same incident near Jharband village in which three laborers were killed and two others sustained serious injuries when a tractor-trolley carrying stone slabs overturned.

The accident occurred during the night of May 11–12, 2000, when a tractor and trolley, registered for agricultural use, were transporting stone slabs. The vehicle, driven by Chandrika Prasad Sahu, overturned due to rash and negligent driving, resulting in the deaths of Rohit Kumar, Tungnath Sahu, and Ghanshyam, while Jhingur and Manbodh were injured.

The appeals, grouped together for a common judgment, involved claims from the victims’ families and the vehicle owner, Awadhram Sahu. The owner contended that the tractor was being used for agricultural purposes and that the insurer, Oriental Insurance Company Limited, should bear the liability. The Insurance Company argued that the tractor-trolley was being used commercially to transport materials on hire, breaching policy conditions.

After examining witness testimony, the court concluded that the vehicle had indeed been used for hire, thereby violating the insurance contract. Citing Oriental Insurance Co. Ltd. v. Brij Mohan and National Insurance Co. Ltd. v. Swaran Singh, the court held that the insurer had successfully established a breach and was not liable to pay compensation directly under the policy.

However, recognizing the socio-economic background of the claimants, Justice Bhadoo directed the Insurance Company to pay the enhanced compensation amounts in the first instance and recover the sums later from the owner and driver.

Under the modified award:

  • Baijnath and Champa, parents of deceased Rohit Kumar, will receive an additional ₹84,800 with 6% interest from July 1, 2000.
  • Pila Dau and Aadharmati, parents of deceased Tungnath Sahu, will receive an additional ₹74,100 with 6% interest.
  • Injured claimant Jhingur Yadav will receive an additional ₹12,000 with 6% interest.

The Court upheld the Tribunal’s finding that the tractor owner, his heirs, and the driver were responsible for the accident but increased the compensation to ensure fair recovery for the victims’ families. It emphasized that although insurance coverage was breached, the law’s benevolent nature required the insurer to initially disburse the amounts before exercising recovery rights. Justice Bhadoo’s order reaffirmed that compensation under the Motor Vehicles Act must balance strict legal liability with the humanitarian purpose of the legislation.
