The Chhattisgarh High Court, in a significant interim ruling, has stayed the operation of an Election Tribunal’s order that had declared the election of the Raipur Mayor void. The order was passed by Justice Fakhruddin while hearing a revision petition filed under Section 441F(2) of the Municipal Corporation Act, 1956.

The petitioner, who was serving as both a Member of the Legislative Assembly (MLA) and Mayor, had challenged the Tribunal’s decision, which held that an MLA’s position constitutes an “office of profit,” making the dual role unconstitutional. The High Court, while admitting the revision petition, observed that the Tribunal appeared to have exceeded its jurisdiction and possibly misconstrued constitutional and legal provisions.

The case has drawn attention because of its implications for legislators across the country, touching on the interpretation of “office of profit” and disqualification under Articles 190, 191, and 243V of the Constitution. The petitioner argued that the Tribunal’s finding conflicted with the Supreme Court’s ruling in Bhagwati Prasad Dixit ‘Ghorewala’ v. Rajeev Gandhi (AIR 1986 SC 1534), which clarified that holding a legislative position does not amount to holding an office of profit under the government.

During the hearing, the Advocate General of Chhattisgarh and counsel for both parties presented detailed arguments on constitutional provisions and precedents, including landmark decisions such as Indira Nehru Gandhi v. Raj Narain (AIR 1975 SC 1590) and Shibu Soren v. Dayanand Sahay (AIR 2001 SC 2583). Justice Fakhruddin noted that the Court must exercise restraint while considering stay applications and avoid commenting prematurely on the merits of the appeal unless the lower court’s findings are “grotesquely erroneous.”

The High Court, taking into account the prima facie strength of the petitioner’s case, stayed the Tribunal’s order dated April 25, 2003. However, the Court imposed specific conditions: the petitioner may continue to function as Mayor but must not draw any salary or allowances. He may use the facilities necessary for discharging his duties, and the Corporation has been directed to maintain accurate records of related expenses.

Justice Fakhruddin emphasized that the observations made in the interim order are strictly for the purpose of granting temporary relief and should not influence the final decision, which will be made after a detailed hearing on merits.

This order underscores a crucial balance between constitutional interpretation and administrative discretion, especially in cases involving elected representatives holding dual offices.
