The Chhattisgarh High Court has upheld the decision of the Raigarh District Collector to stay the effect of a no-confidence motion passed against a Sarpanch. The ruling, delivered by Chief Justice S.R. Nayak, clarified the scope of the Collector’s discretionary powers under the Chhattisgarh Panchayat Raj Adhiniyam, 1993.

The case arose after a no-confidence motion was carried out against the Sarpanch on March 16, 2006, under Section 21(1) of the Act. Following the motion, the Collector issued an interim order staying its effect and scheduled a hearing on April 24, 2006. The petitioners challenged this decision, arguing that once the no-confidence motion was passed, the Sarpanch immediately ceased to hold office and the Collector had no authority to interfere.

Chief Justice Nayak dismissed the petitioners’ argument, holding that while Section 21(1) provides for the immediate cessation of office upon a successful no-confidence motion, it does not limit the Collector’s power to issue interim orders when a reference or appeal under Section 21(4) is pending. The Court reasoned that such discretionary powers are necessary to ensure fairness and prevent miscarriage of justice.

The judgment affirmed that the Collector’s interim stay order was within his legal authority and could not be considered arbitrary or without jurisdiction. Concluding that there was no procedural or legal flaw, the Court dismissed the writ petition as meritless and imposed no costs.

This ruling reinforces the principle that administrative authorities like District Collectors possess inherent discretionary powers to maintain fairness during adjudication, even in matters involving local governance disputes.

(Grant of Stay)
