Chhattisgarh HC quashes DPC’s comparative assessment, orders fresh look at promotion case

The Chhattisgarh High Court has set aside a government order that denied regular promotion to an Assistant Engineer who had been serving as Executive Engineer on an ad hoc basis since 2003. Justice Satish K. Agnihotri held that the Departmental Promotion Committee (DPC) wrongly relied on a comparative assessment of candidates instead of applying the statutory standard of “seniority subject to fitness.”

The dispute arose after the Water Resources Department promoted the petitioner on 9 September 2003 as Executive Engineer on an ad hoc basis. On 1 April 2005, the department refused to confirm him on a regular basis and reverted him to Assistant Engineer. Challenging the reversion, the petitioner argued that the DPC had sidestepped Rule 6 of the Chhattisgarh Public Services (Promotion) Rules, 2003, which governs promotions made on the basis of seniority subject to fitness.

The Court agreed. It noted that under Rule 6(5) and 6(7), the DPC must evaluate each officer’s service record, with particular reference to the last five Annual Confidential Reports, and must categorize each candidate as “fit” or “not fit” on their own merits. The rules do not permit a comparative ranking such as “very good” or “good” to pick winners among otherwise eligible candidates when the criterion is seniority subject to fitness.

The record showed the petitioner had earlier been found fit for ad hoc promotion after being graded A, A, B, C, C up to 2001–02, and there was no pending departmental inquiry or criminal case. No adverse entries affecting promotion were communicated to him. Despite this, the DPC later marked him as not meeting the required criteria by using comparative descriptors and points that favored juniors, a method the Court found contrary to the statutory scheme and natural justice.

Reiterating Supreme Court guidance on “seniority subject to fitness” as a non-selection standard that rejects only the unfit, the High Court held that the DPC’s approach could not stand. It quashed the order dated 1 April 2005, directed the authorities to reconsider the petitioner and other eligible candidates strictly under the 2003 Rules, and allowed the petitioner to continue as Executive Engineer on his ad hoc promotion until a lawful decision is made.

The ruling underscores that where the rule is seniority subject to fitness, the DPC cannot turn the exercise into a merit contest. It must test each officer only for fitness, communicate any adverse material, and then promote according to seniority from the proper select list.
