The Chhattisgarh High Court has clarified that the Juvenile Justice Act does not limit the powers of the High Court or the Sessions Court to grant bail under Sections 438 and 439 of the Criminal Procedure Code. The order came in a case involving a 17-year-old boy, Mohan, who was arrested after authorities seized more than 34 litres of illicit liquor from him.
Mohan had first sought bail under Section 12 of the Juvenile Justice Act. The Juvenile Justice Board refused, noting that his release could expose him to criminal influences and might defeat the ends of justice. He challenged the order before the Sessions Judge, Raipur, but the appeal was dismissed on the same grounds.
Instead of filing a revision petition, the petitioner approached the High Court with a bail application under Section 439 of the CrPC. During the proceedings, he relied on a Punjab and Haryana High Court ruling and asked the court to convert his bail plea into a revision petition.
Justice V. K. Shrivastava examined whether such a conversion was legally permitted and whether the Juvenile Justice Act restricted the powers of higher courts to grant bail. The court held that the Act does not override Sections 438 and 439 of the CrPC. It explained that the non-obstante clause in Section 12 of the Act overrides only Sections 436 and 437, which deal with bail powers of Magistrates. It does not affect the special bail powers vested in the High Court and Sessions Courts.
The court also noted that while the Juvenile Justice Board has the powers of a Judicial Magistrate First Class, it does not have the powers granted under Sections 438 and 439. The High Court and Sessions Court, on the other hand, can use both the CrPC provisions and the powers of the Juvenile Justice Board by virtue of Section 6(2) of the Act.
On the issue of converting a bail plea into a revision, the court said neither the Act nor the CrPC allows such a conversion. A revision petition must follow specific procedural requirements, including limitation and clear grounds of challenge. A bail application under Section 439 does not contain those elements.
The court concluded that Mohan can either file a proper revision petition within the limitation period or seek bail again under Section 439 before the Sessions Court, and only then approach the High Court if needed. With those observations, both his request for conversion and his pending bail plea were disposed of.
