In a significant ruling emphasizing the right to a speedy trial, the Chhattisgarh High Court has directed the release of accused persons who had been in custody for nearly a year in connection with a forgery and cheating case. Justice L.C. Bhadoo allowed their petition under Section 482 of the Criminal Procedure Code (CrPC), setting aside the orders of the trial court and revisional court that had earlier denied them bail.

The accused were facing charges under Sections 420, 467, 468, 471, and 120B of the Indian Penal Code for allegedly fabricating land documents and using fake identities in a sale deed transaction at Raipur. According to the prosecution, they had fraudulently presented two accused as the rightful owners during the execution of the deed, with another accused identifying them before the Sub-Registrar.

After charges were framed in November 2003, the trial commenced in December of the same year. However, despite several hearings, the prosecution failed to complete its evidence within the 60-day period prescribed under Section 437(6) of the CrPC. The accused had filed for bail on the ground of prolonged detention without conclusion of trial, but both the Magistrate and the Additional Sessions Judge dismissed their pleas.

Justice Bhadoo observed that the lower courts had erred in refusing bail by citing the seriousness of the charges. He clarified that the benefit of Section 437(6) applies to all non-bailable offences triable by a Magistrate, irrespective of the punishment attached, unless the delay in trial is attributable to the accused. The Court further emphasized that provisions like Section 437(6) are designed to prevent indefinite detention of undertrial prisoners and to uphold the principle of speedy justice.

The High Court also invoked its inherent powers under Section 482 CrPC, stating that failure to grant bail in such circumstances would amount to a miscarriage of justice. It directed the trial court to release each accused on furnishing a bail bond of ₹10,000 with a surety of the same amount, subject to their appearance on all future hearing dates.

Justice Bhadoo noted that since the trial was unlikely to conclude soon and the accused had already spent about a year in custody, the continued denial of bail was unjustified. The Court’s decision reinforces the judiciary’s duty to balance procedural delays with the personal liberty of the accused.
