The Chhattisgarh High Court has modified a life sentence handed to a Raipur man who was convicted of murdering his wife, reducing the charge from murder under Section 302 of the Indian Penal Code (IPC) to culpable homicide not amounting to murder under Section 304 Part II. Justice L.C. Bhadoo delivered the judgment, holding that the act occurred in the heat of a domestic quarrel without premeditated intent to kill.

The case stemmed from an incident on March 25, 1998, when the accused, after an argument with his wife Usha, struck her repeatedly with a wooden mallet commonly used for washing clothes. Their eight-year-old daughter, Gunjita, witnessed the assault and testified that her parents often quarreled and that her father continued to beat her mother despite her pleas to stop.

After Usha lost consciousness, the accused went to a local compounder, Mohammad Moin, and admitted that he had assaulted his wife. Moin accompanied him home, examined Usha, and found her dead. Following the report by a neighbor, Kaji Habib Ur Rehman, police registered an FIR and began an investigation. The autopsy revealed 14 contusions, fractured ribs, and a ruptured lung, with the cause of death determined as shock and hemorrhage due to thoracic injuries.

The Sessions Court convicted the accused under Section 302 IPC, sentencing him to life imprisonment. However, on appeal, the High Court found that the killing occurred in the course of a sudden quarrel without the intention to cause death. The Court noted that while the accused used a wooden mallet and inflicted serious injuries, there was no evidence of pre-planned intent or motive.

Citing the medical testimony that most injuries were not sufficient to cause death, Justice Bhadoo held that the accused had knowledge that his actions could likely cause death but lacked the intention required for a murder conviction. Accordingly, the Court substituted the life sentence with rigorous imprisonment for six years under Section 304 Part II IPC.

This ruling underscores the Court’s distinction between intentional murder and culpable homicide where death results from a sudden and unplanned act of violence within a domestic setting.
